Import notification for research and development of foreign genetic resources and associated traditional knowledge via the genetic resource registry.

How to get started: Make the notification via the genetic resource registry. The Gene Technology Register is currently out of service. Until the register is back in operation, notifications must be sent by * email to genetic_resources@syke.fi If you have not received the internationally recognized certificate of compliance (IRCC), you must attach the information determined in Article 4, paragraph 3, of EU’s Genetic Resources Decree. The processing time of the notifications vary from a couple of days to a week.

Who it is for: The obligation applies to use of genetic resources and/or traditional knowledge that are covered by the Nagoya Protocol and that are * acquired on 12 October 2014 or later (during the Protocol’s period of validity). * from a country that has ratified/acceded the Nagoya Protocol, that requires prior informed consent (PIC) and that has access legislation in place.

Yrityskauppavalvonnan tavoitteena on turvata markkinoiden kilpailullinen rakenne puuttumalla tarvittaessa etukäteen tehokasta kilpailua olennaisesti estäviin yrityskauppoihin. Yrityskauppavalvonnassa huomion kohteena on markkinoiden rakenne, ja valvonta on luonteeltaan ennaltaehkäisevää. Tietyt liikevaihtorajat ylittävät yrityskaupat on kilpailulain perusteella ilmoitettava Kilpailu- ja kuluttajavirastolle (KKV), eikä kauppaa saa panna täytäntöön ennen viraston asiassa tekemää päätöstä. Ensisijainen tapa kaupan kielteisten kilpailuvaikutusten estämiseksi on asettaa sille ehtoja, esimerkiksi velvoite jonkin liiketoiminnan myymiseen. Kauppa voidaan myös kokonaan kieltää, jos ehtojen määräämisellä ei päästä tyydyttävään lopputulokseen. Silloin kaupan kieltää markkinaoikeus KKV:n esityksestä. Markkinaoikeus voi KKV:n esityksestä paitsi kieltää myös määrätä purettavaksi yrityskaupan tai asettaa kaupalle ehtoja, jos yrityskauppa olennaisesti estää tehokasta kilpailua Suomen markkinoilla tai niiden oleellisella osalla erityisesti siitä syystä, että sillä luodaan määräävä markkina-asema tai vahvistetaan sitä.

Description

The import and export across the EU's external borders of an animal or plant or a product made from it that is subject to the EU CITES legislation usually require a permit. The import and export of endangered species is regulated by the CITES convention (Convention on International Trade in Endangered Species of Wild Fauna and Flora), which has been implemented through EU’s own CITES legislation. The permit regulation applies not only to wild specimens of CITES-listed species, but also to captive-born, farmed and artificially propagated specimens, their parts and products made from them. International cross-border movement of CITES species is regulated by import and export restrictions, depending on how threatened a species is and how much use its populations can endure. In practice, the import and export is controlled through permits issued by national environmental authorities and presented to customs. The CITES-regulated imports and exports include exotic pets, musical instruments, ornamental plants, souvenirs, hunting trophies, leather and fur products, cosmetic products, medicinal products and foodstuffs. Intra-EU imports and exports do not require a CITES permit. Instead, the purchase, sale and other commercial activities within Finland and between EU countries often require a CITES certificate valid within the EU (EU certificate). Commercial activity is understood to be the purchase, offer to purchase, acquisition for commercial purposes, display to the public for commercial purposes, use for commercial gain and sale, keeping for sale, offering for sale or transporting for sale. CITES permits in Finland are issued by the Finnish Environment Institute (Syke). It offers advice and guidance on permits and practices regarding the export, import and transport of animal and plant species and commercial activities under the CITES and EU legislation. The website provides up-to-date information on CITES permit matters. You will find a link to the Cites e-permit service, instructions on how to use the service and how to apply for permits and certificates. Syke's CITES experts can advise you on permit requirements and the process. Permit applications are processed in accordance with Council Regulation (EC) No 338/97. A permit decision is made within one month after the submission of a complete application.

How to use it

Permits and certificates must be valid before starting operations. Without proper documentation, transport across EU borders and trade is illegal. It is the responsibility of a company, community, authority or private person transporting, buying or selling a CITES species to determine whether a permit is required. Information in English on the need for permits and permit procedures is available from the CITES office. ### Determine the need for a permit The determination of whether a permit is needed begins by checking if the species is listed in the Annexes of the EU CITES legislation. The need for a permit and the application process depend on e.g. which Annex of the EU CITES legislation the species is listed in, what kind of activity is in question, and what purpose the specimen of the species, a part of it or a product containing it is used for (commercial or non-commercial). Permits may not be granted for certain species or certain activities. E.g. you may not necessarily engage in commercial activities with more strictly regulated species, and you cannot bring at all some CITES species from certain countries. ### Apply for a permit at the CITES e-permit service If you need a CITES import or export permit, a re-export certificate or an EU certificate, apply for a permit at the CITES e-permit service. You can log in to the service with your Suomi.fi ID. If you are unable to use the service, you can ask for a PDF application form from the CITES office, fill it and send to the Syke.

Conditions

The permit requirements apply not only to companies dealing with species and products covered by the Convention, but also to private individuals (for example pet owners, online retailers, hunters and tourists).

Fee details

The cost of a CITES import, export or re-export permit is EUR 88 and of a EU certificate EUR 55.
